1. Agreement to Terms

1.1 These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Serenova Therapy (“the Company”, “we”, “us”, or “our”) concerning your access to and use of the www.serenovatherapy.co.uk website, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

1.2 By accessing or using our Site and/or Services, you confirm that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with these Terms, you must discontinue use of the Site and Services immediately.

1.3 Supplementary policies and documents referred to in these Terms, including our Privacy Policy, Acceptable Use Policy, and any specific service agreements, form part of this Agreement by reference.

1.4 We may modify or amend these Terms and Conditions from time to time to reflect changes in the law, our services, or business practices. Updates will be posted on the Site with an updated “Revised” date. Your continued use of the Site constitutes acceptance of the revised Terms.

1.5 The Site and Services are directed to individuals residing within the United Kingdom. We do not represent that content available on or through our Site is appropriate for use in other locations.

1.6 The Site is intended for users aged 18 years and above. Users under 18 may only access the Site and Services with verified parental or guardian consent.

1.7 Additional policies which apply to your use of the Site include:

  • Our Privacy Policy, outlining how we process and protect your personal data in compliance with the UK GDPR and Data Protection Act 2018.

  • Our Acceptable Use Policy, specifying the permitted and prohibited uses of this Site.

2. Acceptable Use

2.1 You may only use the Site and Services for lawful purposes, in accordance with these Terms and Conditions.

2.2 You agree not to:

3.1 You warrant that:

(b) You will maintain and promptly update such information to keep it accurate.
(c) You will keep your login and account details secure and confidential.
(d) You have the legal capacity to enter into this Agreement.

3.2 You must promptly notify us at vdc@serenovatherapy.co.uk if you believe your account has been compromised.

3.3 Failure to comply with this section may result in suspension or termination of your account.

4. Content You Provide

4.1 You may be able to submit, upload, or post content (e.g. testimonials, comments, reviews) to the Site (“User Content”).

4.2 You acknowledge that any User Content may be visible to others and grant us a worldwide, perpetual, royalty-free licence to use, reproduce, and adapt your content for promotional, service, or testimonial purposes, subject to anonymisation unless consent is otherwise provided.

4.3 You warrant that your User Content complies with our Acceptable Use Policy and all applicable UK laws, including the Defamation Act 2013.

4.4 We reserve the right to remove any User Content that breaches these Terms or is deemed inappropriate.

5.1 Unless otherwise stated, all content on the Site—including text, graphics, design, videos, code, and other materials (“Our Content”)—is owned or licensed by Serenova Therapy and protected under the Copyright, Designs and Patents Act 1988 and other applicable intellectual property laws.

5.2 You are granted a limited, non-exclusive, non-transferable licence to view and use Our Content for personal, non-commercial purposes.

5.3 You may not reproduce, modify, distribute, or use any part of Our Content without our written permission.

5.4 The information on the Site is for general informational purposes only and is not intended to substitute for professional medical or psychological advice. Always seek qualified guidance before making decisions related to your health or wellbeing.

6. Third-Party Links

6.1 Our Site may contain links to third-party websites. We have no control over, and accept no responsibility for, the content, policies, or practices of such third parties.

6.2 Inclusion of third-party links does not imply endorsement. You access third-party content at your own risk.

7. Site Management

7.1 We reserve the right to:

  • Monitor Site usage for compliance with these Terms;

  • Suspend or restrict access for any user found in breach;

  • Remove any content that violates these Terms or applicable law;

  • Maintain the security and integrity of the Site.

7.2 While we employ reasonable technical measures, we do not guarantee that the Site will be free from bugs, errors, or viruses.

7.3 Users are responsible for maintaining their own antivirus protection and system security.

8. Modifications and Availability

8.1 We may update, modify, or discontinue the Site or Services without prior notice.

8.2 We do not guarantee continuous availability of the Site or Services. Interruptions may occur due to maintenance, system issues, or factors beyond our control.

8.3 We accept no liability for any inconvenience, loss, or damage caused by Site unavailability.

9. Disclaimer and Limitation of Liability

9.1 The Site and Services are provided “as is” and “as available”. We make no express or implied representations or warranties except as required by law.

9.2 Serenova Therapy shall not be liable for indirect, incidental, or consequential damages arising from your use of the Site or Services.

9.3 Nothing in these Terms excludes liability for:

  • Death or personal injury resulting from our negligence;

  • Fraud or fraudulent misrepresentation;

  • Any other matter that cannot be excluded by law.

9.4 If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach.

9.5 Our aggregate liability to you for any claim arising out of or related to the Site or Services shall not exceed the greater of £5,000 or the amount paid by you for Services within the previous six (6) months.

10. Termination

10.1 These Terms remain in effect while you use the Site or Services. You may terminate this Agreement at any time by contacting us at vdc@serenovatherapy.co.uk.

10.2 We reserve the right to suspend or terminate your access to the Site and Services if you breach these Terms or applicable law.

10.3 Upon termination, all provisions intended to survive (including confidentiality, intellectual property, and limitation of liability) shall remain in effect.

11. Mobile Application (if applicable)

11.1 If you access our Services through a mobile application, these Terms extend to the app’s use and access.

11.2 The app is licensed on a limited, non-exclusive, non-transferable basis. App store rules (e.g. Apple App Store, Google Play) may impose additional terms.

12. General Provisions

12.1 All communications between you and Serenova Therapy will be electronic, satisfying any legal requirements for written correspondence under the Electronic Communications Act 2000.

12.2 These Terms, together with all incorporated policies, constitute the entire agreement between you and Serenova Therapy.

12.3 We may assign our rights or obligations under this Agreement without notice. You may not assign your rights without our consent.

12.4 If any provision of these Terms is deemed unlawful or unenforceable, the remainder shall remain in full effect.

12.5 Nothing in these Terms creates a partnership, employment, or agency relationship.

12.6 A person who is not a party to these Terms shall have no right to enforce any of their provisions under the Contracts (Rights of Third Parties) Act 1999.

12.7 These Terms are governed by and construed in accordance with the laws of England and Wales. You and Serenova Therapy agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from or related to these Terms.
